Smileflex Monthly Photo & Video Review Promotion

Effective from: October 1st, 2026

1. About the Promotion

These Terms & Conditions apply to the Smileflex Monthly Photo & Video Review Promotion (the Promotion).

Each calendar month constitutes a separate and independent promotion (a Monthly Promotion), with its own entry period, eligible entry pool, prize and draw. Entries do not roll over between Monthly Promotions.

By entering a Monthly Promotion, an entrant agrees to these Terms & Conditions.

2. Promoter

The promoter is Smileflex Pty Ltd as trustee for The Tyler Family Trust, trading as Smileflex (the Promoter).

3. Eligibility

Entry is open to Australian residents aged 18 years or over who satisfy these Terms & Conditions.

Only the purchaser named on the relevant eligible Smileflex order may enter using that order. A gift recipient, other product user or other third party cannot enter using another person's order.

Directors and employees of the Promoter, contractors directly involved in conducting or administering the Promotion, and their immediate families are not eligible to enter.

A person who has won an Ultimate Smileflex Bundle is not eligible to win another Monthly Promotion for 12 months from the date of their previous win.

4. Monthly Promotion Periods

Each Monthly Promotion opens at 12:00am on the first calendar day of the month and closes at 11:59pm on the final calendar day of that month, based on Melbourne, Victoria time.

An entry belongs to the Monthly Promotion in which the qualifying photo or video is first submitted or added to the review.

Entries do not carry forward into later Monthly Promotions.

The specific closing date, draw date, draw time and draw location for the current Monthly Promotion will be published at smileflex.com.au/review before that Monthly Promotion commences.

5. Eligible Orders

An eligible order must be a genuine, paid and fulfilled Smileflex order containing at least one physical Smileflex product.

Orders purchased during a sale, using a promotional code or paid partly or wholly using a Smileflex Gift Card may qualify.

The following do not constitute eligible orders:

• cancelled or fully refunded orders;
• fraudulent or test orders;
• gift-card-only purchases;
• fully complimentary, promotional, influencer or collaboration orders;
• staff orders supplied free of charge; or
• other products supplied without an underlying genuine paid customer order.

A complimentary remake, adjustment, warranty replacement or other free replacement does not create an additional eligible order. It remains associated with the original eligible paid order and its one-entry limit.

If an otherwise eligible order becomes cancelled or fully refunded before the relevant draw, its entry becomes ineligible.

6. How to Enter

To enter, the purchaser must:

1. submit a genuine review relating to an eligible Smileflex order; and
2. include at least one qualifying photo or video showing their actual Smileflex product.

No additional fee is charged to enter.

There is a maximum of one entry per eligible order, regardless of the number of products in the order, reviews submitted, or photos or videos uploaded.

Separate eligible orders may each generate one entry.

Once an eligible order has been used to enter a Monthly Promotion, that order cannot be used to enter again.

7. 90-Day Submission Period

The qualifying photo or video must be submitted within 90 days after the eligible order is delivered, as reasonably determined using Smileflex and/or carrier delivery records.

Where a customer initially submits a text-only review and later adds a qualifying photo or video, the entry is created on the date that qualifying media is added, provided it is still within the 90-day period.

Adding qualifying media after the 90-day period does not create an eligible competition entry.

8. Photo and Video Requirements

Qualifying media must:

• be original content created by the entrant;
• clearly show the entrant's actual Smileflex product from the eligible order;
• be relevant to the review; and
• allow the Smileflex product to be reasonably identified.

Photos or videos do not need to be professionally produced or portray the product positively.

Screenshots of the Smileflex website, Smileflex product-page images, stock images, unrelated media, AI-generated images or videos, or media materially altered or manipulated, including using AI, to misrepresent the product or order are not eligible.

Ordinary edits such as cropping, brightness adjustments or minor colour corrections are permitted provided they do not materially misrepresent the product.

Media in which the Smileflex product cannot reasonably be identified is not eligible.

The entrant must own or otherwise have the necessary rights to submit the media.

9. Reviews and Moderation

Reviews must reflect the entrant's genuine experience and opinion.

Positive, neutral and negative reviews are treated equally. The rating, sentiment or favourability of a review does not affect eligibility or the entrant's chance of winning.

Entrants may edit or update their review without losing their entry provided the review remains genuine and qualifying media remains attached.

Changing a star rating, wording or opinion does not create another entry and does not invalidate an otherwise eligible entry.

If an entrant removes all qualifying media or deletes their review before the draw, the entry becomes ineligible.

If a review or its media is removed because it is fraudulent, duplicated, unlawful, copied, misleading, spam or otherwise breaches these Terms & Conditions or applicable review-platform requirements, the associated entry may be void.

Multiple reviews relating to the same eligible order remain limited to one competition entry.

10. Prize

Each Monthly Promotion has one prize: the Ultimate Smileflex Bundle, with a current total recommended retail value of $580, comprising:

• ultraLED™ Whitening Kit — RRP $219;
• ultraLED™ Whitening Pen — RRP $29;
• Waves™ Cleansing Pod — RRP $169;
• Premium Cleansing Tablets — RRP $24;
• Premium Sterilising Foam — RRP $39; and
• $100 Smileflex Gift Card.

The total RRP stated above is accurate at the date these Terms & Conditions are published and may change as individual product prices change. The prize is defined primarily by its listed contents.

Delivery of the prize to a valid Australian address is included at no charge.

The prize is not transferable and cannot be redeemed for cash.

Individual products cannot be exchanged for cash, store credit or alternative products at the winner's request.

If a prize item becomes unavailable, the Promoter may substitute an item of equal or greater retail value where reasonably necessary and permitted by law.

The $100 Smileflex Gift Card is subject to Smileflex's standard gift-card terms.

11. Draw

Each Monthly Promotion will be drawn on the third business day of the following month at 12:00pm Melbourne time, at Smileflex, Bayswater VIC.

The exact draw date for each Monthly Promotion will also be published at smileflex.com.au/review.

The draw will be conducted electronically using a random method that gives every eligible entry an equal chance of selection.

Entrants do not need to be present at the draw.

The Promoter will keep reasonable records of each draw, including the eligible entry pool, date and time of the draw, the selected entry and any redraw.

12. Winner Verification

Selection in the random draw is subject to eligibility verification.

Before confirming the result, the Promoter may verify matters including:

• the eligible order and purchaser;
• fulfilment and delivery details;
• the 90-day submission period;
• the one-entry-per-order requirement;
• compliance of the photo or video;
• the review and media remaining available at the time of the draw;
• the entrant's age and Australian residency; and
• any other requirement of these Terms & Conditions.

If a selected entry does not satisfy these Terms & Conditions, it is void and another eligible entry will be randomly selected from the remaining entry pool.

The Promoter may use order details, customer details and review information reasonably necessary to verify eligibility.

13. Winner Notification and Publication

The verified winner will be notified by email within 2 business days of the draw and in any event within the period required by applicable law.

The winner will be given 30 days from notification to claim the prize and provide any reasonably required delivery information.

Results will be published at smileflex.com.au/review for at least the period required by applicable law.

A confirmed result will ordinarily be displayed in the following format:

October 2026 — John S. — VIC

Only the winner's first name, surname initial and Australian state or territory will be published. Full surnames, email addresses, residential addresses and other private contact information will not be publicly displayed.

14. Unclaimed Prizes and Redraws

If a winner does not claim the prize within 30 days, they forfeit their right to the prize.

A redraw will then be conducted from the remaining eligible entries for that same Monthly Promotion on the next business day at 12:00pm Melbourne time at the Promoter's business address, using the same random electronic method.

Any replacement winner will be subject to the same verification, notification and publication requirements.

Entries from the affected Monthly Promotion do not roll into another month's promotion.

15. Incentivised Review Disclosure

Entry into a Monthly Promotion is an incentive offered in connection with submitting a qualifying review.

The incentive is available regardless of the review's star rating, sentiment or content, provided the entry otherwise complies with these Terms & Conditions.

Qualifying reviews may be identified as rewarded, incentivised or otherwise disclosed as having been submitted in connection with the Promotion when displayed by Smileflex or its review platform.

The Promoter will not increase an entrant's chance of winning because they provide a favourable review.

16. Privacy and Use of Information

The Promoter may use an entrant's order details, review information and contact details as reasonably necessary to:

• verify eligibility;
• administer the Promotion;
• conduct the draw;
• contact and verify winners;
• publish winner information in accordance with clause 13; and
• deliver prizes.

Personal information is otherwise handled in accordance with Smileflex's Privacy Policy and applicable privacy law.

Entering the Promotion does not automatically subscribe an entrant to marketing communications where they have not otherwise consented to receive them.

17. Review Photos and Videos

A review and its attached media may continue to appear wherever Smileflex ordinarily displays customer reviews, subject to the review platform's and Smileflex's applicable terms.

Entry into the Promotion does not, by itself, grant Smileflex any additional blanket right to use an entrant's photo or video in paid advertising, email marketing, standalone social advertising, website banners or other unrelated promotional campaigns.

Where Smileflex wishes to use customer media more broadly than its ordinary review display, separate permission may be requested from the customer.

18. Disqualification

The Promoter may disqualify an entrant or entry where the entrant:

• breaches these Terms & Conditions;
• provides false or misleading information;
• impersonates another person;
• submits content they do not own or have the right to use;
• uses bots, automated submissions, multiple identities or other methods to circumvent the entry restrictions;
• tampers with or manipulates order, review or competition systems;
• submits fraudulent or fabricated media;
• submits unlawful, defamatory, threatening, obscene, discriminatory or otherwise unlawful content; or
• otherwise interferes with the fair or proper conduct of the Promotion.

If disqualifying conduct is discovered after selection but before the prize is issued, the Promoter may void the result and conduct a redraw.

The Promoter will not disqualify an entrant merely because their genuine review is negative or critical.

19. Technical Issues and Circumstances Beyond Reasonable Control

Where a technical failure, platform outage or other circumstance outside the Promoter's reasonable control affects the Promotion, the Promoter may take reasonable steps to verify affected entries manually.

If circumstances beyond the Promoter's reasonable control materially prevent a Monthly Promotion from operating as intended, including technical failures, fraud, tampering or other interference, the Promoter may, subject to applicable law, reasonably suspend, modify, postpone or cancel the affected Monthly Promotion.

Where reasonably possible, existing valid entries will be preserved.

Material changes should apply prospectively to future Monthly Promotions wherever reasonably possible and should not retrospectively disadvantage entrants who have already entered.

20. Delivery and Use of the Prize

The winner must provide a valid Australian delivery address.

If a prize is returned because the winner supplied incorrect or incomplete delivery information or failed to collect the parcel, the Promoter may require the winner to meet reasonable additional redelivery costs.

If the prize is lost or damaged during delivery, the Promoter will deal with the matter in accordance with applicable law and its normal customer-service processes.

Prize products must be used in accordance with their ordinary instructions, warnings and conditions of use.

The winner is responsible for personal expenses associated with accepting or using the prize that are not expressly included.

21. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

22. Records

The Promoter will keep reasonable records relating to each Monthly Promotion, including entry, draw, winner and prize-distribution records, for at least three months after the relevant draw or for any longer period required by law.

23. General

The Promoter will make eligibility, verification and administrative decisions reasonably, in good faith and consistently with these Terms & Conditions.

An accidental typographical, formatting or administrative error will not invalidate a Monthly Promotion where it does not materially prejudice entrants.

If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions continue to apply.

A failure by the Promoter to enforce a provision on one occasion does not constitute a waiver of that provision.

If abbreviated promotional material is inconsistent with these Terms & Conditions, these Terms & Conditions prevail to the extent permitted by law.

24. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Entrants submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

Nothing in this clause limits any mandatory law or regulatory requirement applying in another Australian state or territory.
